Drama At High Court During Byabakama Case

“Whether another judge comes or not, something must be done, the case is not going to die,” were the remarks made by the judge of civil division High Court, Justice Musa Sekana.

This came after a ruling Sekana made that the chairperson of the Electoral Commission Justice Simon Byabakama and the secretary for the Electoral Commission Sam Rwakoojo will not appear before court to explain why they are handling two government offices at a time.

The application was filed by Council Male Mabilizi seeking to have Byabakama and Rwakoojo appear in court to defend themselves as to why they were handling two government offices.

Before Justice Sekana could deliver a ruling, Mabilizi stood up and asked court to arrest the ruling which the judge declined and delivered his ruling describing Mabilizi’s statement as rubbish.

“I am overruling you until after i have delivered it, I have overruled you, either wait for the ruling or they throw you out and I can do extremes and you end up in Luzira,” said Justice Musa Sekana.

After Sekana delivered the ruling, Mabilizi rejected it saying that he knew what would happen claiming that Sekana could not deliver a ruling against people he had been working for as lawyer.
