Justice Musa Ssekana Refuses To Step Aside

Justice Musa Sekana has refused to step aside and let another judge take over the case in which Male Mabirizi and Erias Lukwago sued the chairperson of the Electoral Commission Justice Simon Byabakama for holding two offices.

The two councils had accused the presiding judge of conflict of interest and asked that he steps down. In a document left with the registrar Sarah Langa, Justice Ssekana said that he will continue to preside over the case even after he was transferred to Mbarara.

Ssekana accuses the petitioners of using politics to push him away from the matter. The petitioners, however, have vowed to continue with the fight until justice prevails.

“The judge has insisted he is not going to withdraw from this case, he was transferred to Mbarara, he even made this ruling from Mbarara, we expected that he handover the file to be reallocated to another judge, but he has shocked us to say that he is going to hear this case from Mbarara”, said Erias Lukwago.

Lukwago expressed his frustration wondering whether the case is going to be heard from Mbarara. He said that it is ridiculous saying that the petitioners respect the judge but they do not believe in his ruling.
